Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Fuzzy Verify website at www.fuzzyverify.com, the Fuzzy Verify mobile application, and any related features, content, software, and services (collectively, the "Services") offered by SafeHer, Inc. ("Fuzzy," "Company," "we," "our," or "us"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.

3. Description of the Services

Fuzzy Verify is designed to help users establish and share proof of human identity and authenticity in digital interactions. In the current app version, the Services center on user-consented identity verification, verified profiles, badge issuance, badge scanning or sharing, and related account features that make proof of human portable for safer online interactions. The Services do not promise to determine a user's character, intentions, safety, or future conduct.

Users may submit information about themselves in order to create or maintain an account, complete verification, and manage profile settings.

Users who complete verification may receive a verified status, badge, or profile indicator reflecting successful completion of the available verification steps at a point in time.

Verification results depend on information supplied directly by the user during the verification process and on checks carried out through the Services, including identity verification checks performed with Incode where applicable.

The current app version is not a broad public-record people-search or background report product and is not intended to provide users with third-party dossier-style search results about other individuals.

4. Verification Process

If you choose to verify your identity, you may be asked to provide information such as a government-issued ID, selfie, liveness capture, profile photo, and other information necessary to complete the verification workflow. We may use Incode as a verification service provider. You authorize us and our service providers to process that information to verify identity, reduce fraud, protect platform integrity, maintain records, satisfy compliance requirements, and support reverification consistent with applicable law and the governing privacy notices. The current Fuzzy Verify app iteration does not provide third-party data about other individuals to users.

5. No Consumer Reports; No FCRA Use

The Services are not a consumer reporting agency service, employment screening service, tenant screening service, investigative consumer report, or similar regulated background checking product. You may not use the Services, or any information obtained from the Services, to determine a person's eligibility for employment, housing, credit, insurance, education, benefits, licensing, or any other purpose governed by the Fair Credit Reporting Act or similar laws.

6. User Accounts and Security

You may need to create an account to use some features. You agree to provide accurate, current, and complete information, keep your credentials secure, and notify us promptly of any unauthorized access to or use of your account. You are responsible for activity under your account to the extent permitted by law.

7. Verified Status and Badge Meaning

A verified badge, status marker, or profile indicator means only that the user completed the verification steps then required by Fuzzy and successfully passed the available checks at that time. A verified badge is not a guarantee that a user is safe, truthful, compatible, reputable, or free from misconduct. Verification may expire, be revoked, or require renewal.

8. Permitted Use

You may use the Services only for lawful, personal, internal, and authorized purposes. You may not misuse the Services or use them in a manner that violates another person's rights, privacy, or safety.

You may not impersonate another person or submit false or misleading information.

You may not use the Services to harass, stalk, threaten, defame, exploit, dox, discriminate against, or otherwise harm another person.

You may not reverse engineer, scrape, frame, copy, sell, resell, lease, sublicense, or commercially exploit the Services or their output except as expressly authorized in writing.

You may not use bots, spiders, or automated tools to access or extract content from the Services except through expressly permitted interfaces.

You may not interfere with the operation, security, integrity, or performance of the Services.

9. Content and Profile Information

You remain responsible for information, images, social handles, and other materials you submit to the Services. You represent that you have the rights and authority necessary to provide that information and to permit the Company and its service providers to use it as described in these Terms and the Privacy Policy. We may remove, restrict, or disable content or profile information if we believe it violates these Terms, creates legal or safety risk, or undermines the integrity of the Services.

10. Fees, Purchases, and Subscriptions

No paid features are currently live in this app version. If paid features, subscriptions, or in-app purchases are introduced later, the pricing, renewal terms, included benefits, and cancellation mechanics shown at the point of purchase will apply. Purchases made through the Apple App Store are also subject to Apple's billing, renewal, cancellation, and refund rules.

11. Account Suspension, Termination, and Deletion

We may suspend, restrict, revoke, or terminate access to the Services if we believe you violated these Terms, provided false information, misused the Services, created safety or legal risk, or interfered with our systems or other users. You may stop using the Services at any time. If you request account deletion, we will process that request subject to any information we must retain for legal, security, fraud-prevention, billing, audit, dispute-resolution, or compliance purposes.

12. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Services, you acknowledge that we may process information in accordance with that policy.

13. Intellectual Property

The Services, including software, text, branding, graphics, workflows, and other content made available by the Company, are owned by or licensed to us and are protected by intellectual property and other laws. Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you.

14. Third-Party Services

The Services may rely on third-party providers that support identity verification, hosting, analytics, payments, and app-store distribution. We are not responsible for third-party products or services except as required by applicable law, but we may share information with such providers as needed to operate, secure, support, and improve the Services. The current Fuzzy Verify app iteration does not provide third-party data about other individuals to users.

15. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUFFICIENT FOR YOUR PARTICULAR NEEDS, OR THAT ANY VERIFIED STATUS, PROFILE, OR BADGE WILL PREVENT FRAUD, MISREPRESENTATION, OR HARM.

16. Limitation of Liability

To the fullest extent permitted by law, the Company and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, exemplary, special, or punitive damages, or for any loss of data, profits, revenues, goodwill, or business opportunities arising out of or related to the Services or these Terms. To the fullest extent permitted by law, our aggregate liability for claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid to us for the Services in the 12 months before the event giving rise to the claim, or (b) US $100.

17. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys fees, arising out of or relating to your use of the Services, your content or submissions, your violation of these Terms, or your violation of law or another person's rights.

18. Dispute Resolution and Class Action Waiver

To the extent permitted by law, disputes between you and the Company must be brought on an individual basis and not as part of a class, consolidated, or representative action. SUBJECT TO THE TERMS OF THIS SECTION, YOU AND THE COMPANY AGREE THAT ANY AND ALL CLAIMS THAT HAVE ARISEN OR MAY ARISE BETWEEN YOU AND THE COMPANY SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION IN KENT COUNTY DELAWARE ON AN INDIVIDUAL BASIS, RATHER THAN IN COURT. Agreeing to this arbitration is not a mandatory condition of your contractual relationship with the Company. If you do not want to be subject to this arbitration provision, you may opt out. 19. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent preempted by federal law or limited by non-waivable consumer protections. Disputes will be resolved in the state or federal courts located in Kent County, Delaware.

20. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. If we make material changes, we will post updated Terms and revise the effective date. Your continued use of the Services after the changes become effective means you accept the revised Terms.
